Terms of Service
Effective Date: 26 March 2026  · Governing Host and Guest Use of the KlensecRent Platform
1. Agreement to Terms
These Terms of Service (âTermsâ) constitute a legally binding agreement between you and KlensecRent. By registering, accessing, or using the KlensecRent platform, you agree to be bound by these Terms. If you do not agree, you must not use the platform.
These Terms are governed by the laws of Ghana, including the Contracts Act, 1960 (Act 25), the Electronic Transactions Act, 2008 (Act 772), and the Ghana Data Protection Act, 2012 (Act 843).
2. Definitions
- Platform: The KlensecRent website, mobile applications, and all associated services
- Host: A registered user who lists a property for rent on the platform
- Guest: A registered user who books a property listed on the platform
- Listing: A property advertised for rent by a Host on the platform
- Booking: A confirmed reservation of a Listing by a Guest
- Rental Fee: The amount agreed upon between Host and Guest for a Booking
- Service Fee: The commission charged by KlensecRent for facilitating a Booking
3. Account Registration
To use the platform, you must:
- Be at least 18 years of age
- Provide accurate and complete registration information
- Verify your identity using a valid Ghana Card, passport, or driverâs licence
- Maintain the confidentiality of your account credentials
- Not create more than one personal account
You are responsible for all activity that occurs under your account. Notify us immediately at rent@klensecrent.com if you suspect unauthorised access.
4. Host Terms and Obligations
4.1 Listing a Property
As a Host, you represent and warrant that:
- You are the legal owner of the property or have the ownerâs written authorisation to list it
- The property complies with all applicable Ghanaian building, health, safety, and zoning regulations
- All information in your Listing is accurate, current, and not misleading
- You hold any permits or licences required under Ghanaian law for short-term rentals
- The property is free from outstanding legal encumbrances that would prevent lawful rental
4.2 Host Responsibilities
- Maintain the property in a safe, clean, and habitable condition at all times
- Honour all confirmed Bookings unless cancelled in accordance with the Cancellation Policy
- Provide accurate check-in instructions and be accessible to Guests during their stay
- Carry adequate property insurance covering short-term rental activities
- Collect and remit any applicable taxes, including Ghana Revenue Authority requirements
- Respond to Guest messages within 24 hours of receipt
4.3 Prohibited Listings
Hosts must not list:
- Properties with fraudulent or misleading descriptions or photos
- Properties that are subject to active legal disputes or enforcement actions
- Properties being used for illegal activities
- Properties in residential areas where short-term rental is prohibited by local ordinance or estate rules
4.4 Host Fees and Payments
- KlensecRent charges a Service Fee (communicated in the fee schedule at the time of booking) on each completed Booking
- Payouts are made to Hosts within 24 hours of a Guestâs confirmed check-in, via bank transfer or mobile money
- KlensecRent reserves the right to withhold payouts pending resolution of disputes or investigation of suspected fraud
5. Guest Terms and Obligations
5.1 Making a Booking
As a Guest, by confirming a Booking you agree to:
- Pay the full Rental Fee and applicable Service Fee at the time of booking
- Comply with all House Rules specified in the Listing
- Arrive and depart at the agreed check-in and check-out times
- Not exceed the maximum number of occupants stated in the Listing
- Treat the property and its contents with care and respect
5.2 Guest Responsibilities
- You are responsible for all damage to the property caused by you or your invitees beyond normal wear and tear
- You must not use the property for commercial purposes, events, or parties without the Hostâs prior written consent
- You must not smoke in non-smoking properties or bring pets to pet-free properties
- You are responsible for complying with all applicable laws during your stay
- You must report any damage or maintenance issues to the Host and KlensecRent promptly
5.3 Guest Fees and Refunds
- The total amount payable, including all fees, is displayed before you confirm a Booking
- Refunds are subject to the Hostâs cancellation policy as displayed on the Listing
- KlensecRentâs Service Fee is non-refundable except where KlensecRent cancels a Booking due to platform error
6. Cancellation Policy
Cancellation terms are set by the Host and clearly displayed on each Listing. KlensecRent offers three standard policies:
- Flexible: Full refund if cancelled at least 7 days before check-in
- Moderate: Full refund if cancelled at least 5 days before check-in
- Strict: 50% refund if cancelled at least 24 hours before check-in; no refund after that
In cases of verified force majeure (natural disaster, government-mandated restriction), KlensecRent may issue full refunds at its discretion.
7. Payments
- All payments are processed through KlensecRentâs approved payment partners, including mobile money providers licensed in Ghana
- KlensecRent holds rental funds in escrow until check-in is confirmed before releasing to the Host
- Any payment disputes must be reported to KlensecRent within 48 hours of the relevant transaction
- KlensecRent is not liable for transaction fees charged by your bank or mobile money provider
8. Prohibited Conduct
All users are prohibited from:
- Providing false or misleading information to KlensecRent or other users
- Circumventing the platform to arrange bookings directly and avoid Service Fees
- Harassing, threatening, or discriminating against other users
- Using the platform to facilitate illegal activities, including human trafficking or drug distribution
- Scraping, copying, or reverse-engineering the platform
- Posting defamatory, obscene, or fraudulent reviews or content
9. Dispute Resolution
KlensecRent provides a mediation service for disputes between Hosts and Guests. The process is:
- Either party submits a dispute claim within 72 hours of the relevant incident via rent@klensecrent.com
- KlensecRent reviews evidence and attempts mediated resolution within 7 business days
- If mediation fails, disputes shall be referred to arbitration under the Alternative Dispute Resolution Act, 2010 (Act 798) of Ghana
- Formal legal proceedings shall be brought in the courts of Ghana, which have exclusive jurisdiction
10. Platform Availability and Liability
KlensecRent provides the platform on an âas isâ basis and does not guarantee uninterrupted service. We are not liable for:
- Losses arising from Host or Guest misconduct
- Inaccuracies in Listings
- AWS or third-party service outages beyond our reasonable control
- Indirect, consequential, or incidental damages
Our total liability to you shall not exceed the total Service Fees paid by you in the 12 months preceding the claim.
11. Intellectual Property
All content, trademarks, logos, and technology on the KlensecRent platform are owned by or licensed to KlensecRent. You may not reproduce, distribute, or create derivative works without our written consent.
12. Termination
KlensecRent may suspend or terminate your account if you:
- Breach these Terms
- Engage in fraudulent, abusive, or illegal conduct
- Receive sustained negative reviews indicating unsafe hosting or guest behaviour
You may close your account at any time by contacting rent@klensecrent.com. Outstanding obligations (including payments) survive termination.
13. Amendments
We may update these Terms at any time. You will be notified of material changes at least 14 days in advance via email. Continued use of the platform constitutes acceptance.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Ghana. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ghana.
